Welcome to LocalDanceStudio.com ("LocalDanceStudio," "we," "us," or "our"). By accessing or using our website at localdancestudio.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.

1. Eligibility

You must be at least 18 years old to use this Site or create an account. By using the Site, you represent and warrant that you are at least 18 years of age. If you are under 18, you may not use the Site, create an account, or submit any information to us.

2. Description of Service

LocalDanceStudio is a directory of dance studios across the United States. We aggregate publicly available information about dance studios and present it in a searchable format. Studio owners may claim their listings, update their information, and upload photos. Users may browse studio listings, search by location or dance style, and contact studios directly.

We do not operate any dance studios, employ any dance instructors, or provide any dance instruction or related services. We are solely a directory and informational resource.

3. User Accounts

To claim a studio listing or access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately at hello@localdancestudio.com if you become aware of any unauthorized use of your account.

4. Studio Claiming and Verification

By claiming a studio listing, you represent and warrant that you are authorized to act on behalf of that studio. You must be an owner, operator, manager, or other authorized representative of the business. Claiming a studio you are not authorized to represent is a violation of these Terms and may result in account termination.

We reserve the right to verify your authorization at any time and to revoke a claim if we determine it was made without proper authority.

5. User-Generated Content

You may submit content to the Site, including but not limited to photos, studio descriptions, and other information ("User Content"). You retain ownership of your User Content. However, by submitting User Content, you grant LocalDanceStudio a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with operating and promoting the Site.

You represent and warrant that:

  • You own or have the necessary rights to submit the User Content.
  • Your User Content does not infringe the intellectual property or other rights of any third party.
  • Your User Content is accurate and not misleading.
  • Your User Content does not violate any applicable law or regulation.

We reserve the right to remove any User Content at our sole discretion, for any reason, without notice.

6. Acceptable Use

You agree not to:

  • Submit false, misleading, or fraudulent information, including fake studio listings.
  • Claim a studio listing you are not authorized to represent.
  • Use automated tools, bots, scrapers, or similar technology to access, collect, or extract data from the Site.
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Site for commercial purposes without our express written consent.
  • Interfere with or disrupt the Site or servers or networks connected to the Site.
  • Upload viruses, malware, or other harmful code.
  • Harass, abuse, or threaten other users or studio owners.
  • Use the Site to send unsolicited advertising or spam to studios listed on the platform.
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or systems.
  • Create a competing directory or database by systematically downloading or compiling our data.

7. Accuracy of Information

Studio listings on LocalDanceStudio may be based on publicly available information and may not be current, complete, or accurate. We do not verify the accuracy of studio information, including but not limited to business hours, contact details, class schedules, pricing, instructor qualifications, or dance styles offered.

All directory information is provided "as is" without any warranty. You should independently verify any information before relying on it, including contacting studios directly to confirm details.

We are not responsible for any decisions you make based on information found on the Site.

8. Intellectual Property

The Site and its original content (excluding User Content), features, and functionality are owned by LocalDanceStudio and are protected by copyright, trademark, and other intellectual property laws. Our name, logo, and branding may not be used without our prior written consent.

9. Third-Party Links

The Site may contain links to third-party websites, including studio websites and social media profiles. We are not responsible for the content, accuracy, or practices of any third-party sites. Visiting third-party links is at your own risk.

10. Account Termination

We may suspend or terminate your account at any time, for any reason, with or without notice, including but not limited to violations of these Terms. Upon termination, your right to use the Site ceases immediately.

You may delete your account at any time by contacting us at hello@localdancestudio.com. Upon account deletion, your personal data will be removed within 30 days, as described in our Privacy Policy.

If you have claimed a studio listing, deleting your account will release the claim, but the studio listing itself will remain on the Site as part of our public directory.

11. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not endorse, recommend, or guarantee any studio listed on the Site.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCALDANCESTUDIO AND ITS OWNERS, OPERATORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS.

13. Indemnification

You agree to indemnify, defend, and hold harmless LocalDanceStudio and its owners, operators, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site, your User Content, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution and Arbitration

Please read this section carefully — it affects your legal rights.

You and LocalDanceStudio agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved through binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

Class Action Waiver: You agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in the state of Tennessee or remotely, at the arbitrator's discretion. The arbitrator's decision shall be final and binding.

30-Day Opt-Out: You may opt out of this arbitration provision by sending written notice to hello@localdancestudio.com within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective Date" at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
